High Court gives justice to elderly woman harassed by son and daughter-in-law

Delhi. Delhi High Court took a son and daughter-in-law to task and said that they want their elderly mother’s property but are not willing to give the old lady the right to live in peace. In its decision, the High Court ordered the eviction of the son, daughter-in-law and their children from the old lady’s house. Justice Sanjeev Narula’s bench said in its order that the allegations of misbehavior, financial exploitation and mental harassment of the old lady have been proved before the District Magistrate. It was also proved that the daughter-in-law of the old lady has filed a domestic violence case against her unmarried sister-in-law leaving her husband and mother-in-law. Prima facie it also appears that the step was taken with the intention of taking revenge on the old lady for demanding eviction of the son, daughter-in-law and her family under the Delhi Parents and Senior Citizens Maintenance and Welfare Rules, (Amendment) Rules, 2016. However, the District Magistrate, considering that the property in question was bought by the elderly woman’s husband, the husband has now died, so now this property belongs to the elderly woman. The District Magistrate had ordered the son-daughter-in-law and their family to vacate the elderly woman’s house. The High Court has upheld it.

During the hearing, it was decided under mediation that the son-daughter-in-law will pay Rs 3,000 per month to the elderly woman. However, the elderly woman said that the family has broken up. She just wants to live a peaceful life, so it would be appropriate for the son-daughter-in-law and their family to leave the house.

A shocking thing came to light in this case. The son and daughter-in-law had even stopped the elderly mother from getting air and light. The mother was forced to lodge a complaint at the Jafrabad police station. The police found the complaint to be correct. Actually, one son and daughter-in-law of the elderly live on the ground floor. The elderly was living on the first floor with her unmarried daughter. The second son and daughter-in-law lived on the second floor of this house with their family. The son and daughter-in-law living on the second floor blocked the elderly woman’s way to the terrace. They obstructed the repair of the water tank. Even the light and air on the floor where the elderly woman was living was obstructed.
