New Delhi: A Delhi court has sentenced a woman to six months in jail for not filing ITR on income of Rs 2 crore for the financial year 2013-14. The woman has been identified as Savitri.
Additional Chief Metropolitan Magistrate (ACMM) Mayank Mittal also imposed a fine of Rs 5,000 on Savitri, along with a separate imprisonment of one month in default. The matter came to light from a complaint by the Income Tax Office (ITO), which said that TDS of Rs 2 lakh was deducted from Savitri during the financial year 2013-14. However, she failed to file returns for assessment year 2014-15.
The defense cited Savitri’s personal circumstances, saying that she was a widow and had no one else in her family. The court gave this decision after several notices and penalty orders issued to Savitri by the Income Tax Office were ignored. Following due procedure, the Principal Commissioner of Income Tax, New Delhi asked for prosecution of Savitri under the IT Act.
While convicting Savitri, the court said that the prosecution had successfully proved the issuance and service of the notice and that she had failed to file the required tax returns. Moreover, she could not produce any evidence of her mental condition under Section 278E of the IT Act, due to which she was convicted.
