Supreme Court to continue stay on Election Commission from taking decision on double leaf

Tamil Nadu: Supreme Court dismisses plea challenging Madras High Court order that Election Commission should not take any decision regarding two leaf symbol. Supreme Court dismisses appeal and directs to move Madras High Court.

The Election Commission of India was conducting several investigations following the order issued by Madras High Court in Suryamoorthy’s ongoing case that the double leaf symbol should be disabled. The Election Commission had ordered that petitioners Edappadi Palaniswami, O Panneerselvam, K.C. Palaniswami and Bhujanendar all file replies in the case. Edappadi Palaniswami recently filed an additional petition in Madras High Court. Suryamoorthy, who had filed a petition in the Election Commission regarding AIADMK and the two leaf symbol, said that he is not a member of AIADMK.

A person who is not a member of AIADMK has no mechanism to sue the party and its symbol. A person who is not an original member of the party cannot petition the Election Commission regarding the internal affairs of the party. He demanded that the Election Commission should dismiss Suryamurthy’s petition. After this, the Madras High Court gave an interim order to the Election Commission to investigate regarding the post of AIADMK General Secretary. MG Ramachandran appealed to the Supreme Court against the ban imposed by the Madras High Court.
The Supreme Court dismissed the appeal filed regarding the two leaves election symbol. The petition was dismissed because the appellant withdrew the petition challenging the order passed by the Madras High Court. Therefore, the ban on the Election Commission from taking any decision regarding the double leaf election symbol continues.
