These officers and employees will not be transferred, High Court orders

Bilaspur. The current decision of the Chhattisgarh High Court is a relief news for the officers and employees working in various departments of the state. If an officer or employee has one year left for retirement, then he will not be transferred elsewhere. The court has given this important decision while hearing the petition of EE Arun Sharma of Korba Municipal Corporation. Actually, engineer Arun Sharma has five months left for retirement. Engineer Sharma had filed a petition citing the policy set by the government.

For the last four days, the state government has been issuing transfer orders in bulk for various departments. In the list issued in bulk for transfer, the officers of the state government are not even caring about the rules, laws and criteria. One such case is of Korba Municipal Corporation. Engineer Arun Sharma, posted on the post of EE here, has been transferred to Bilaspur Municipal Corporation. Challenging the transfer done by the Urban Administration Department, Engineer Sharma filed a petition in the Chhattisgarh High Court through his advocate.

In the petition filed, the transfer policy and criteria made by the state government have been cited. The petitioner has said in his petition that it is clearly mentioned in the transfer policy made for government employees that, if any officer or employee has one year left for retirement, then he will not be transferred elsewhere. According to the petition, the state government has directly violated its own transfer policy in his case. The petitioner engineer told that only five months are left for his retirement. Despite knowing this, the departmental officers have transferred him. After hearing the case, the High Court has put a stay on the transfer order issued by the state government and has allowed the petitioner to continue serving in Korba Municipal Corporation till retirement.
