Registration of Raipur’s Anand Vihar Residents Society Cancelled

Raipur. The state government has initiated action against residential societies of real estate projects that registered under misclassified Acts and, contrary to those provisions, undertook colony maintenance and fee collection. Consequently, the Registrar, Firms and Societies, Chhattisgarh has cancelled the registration of Raipur’s Anand Vihar Residents Development Society and issued notices to 360 residential societies registered under similar misclassified categories. This action was taken because these societies are registered under an Act that does not permit the collection of daily maintenance charges, even though they were carrying out such activities. Residential societies must be registered under the Chhattisgarh Cooperative Act, 1960.
According to the Real Estate (Regulation and Development) Act, 2016, it is mandatory to form an allottees’ association or cooperative society within three months after more than 50 percent of the units or plots in any real estate project have been booked. These societies are responsible for the maintenance and management of the colony.
According to the Registrar’s office, registration under the Chhattisgarh Societies Registration Act, 1973 as amended in 1998, is meant only for organisations with social, educational, and cultural objectives as defined in Section 2 of the Act. It does not include provisions related to daily maintenance or upkeep. Therefore, residential societies of real estate projects must be registered under the Chhattisgarh Cooperative Act, 1960. In violation of these rules, Anand Vihar Residents Development Society was found to be undertaking maintenance work and collecting fees contrary to its registered objectives. After complaints and hearings, its registration was cancelled under Section 34 of the Act.
Smt. Padmini Bhoi Sahu, Registrar, Firms and Societies, Chhattisgarh, has directed all 360 such societies in the state that if their objectives are contrary to Section 2 of the Act, they must submit amendment proposals within 15 days on the online portal rfas.cg.nic.in. Failure to make corrections within the stipulated time or receipt of a complaint will lead to cancellation of registration.
