Rajasthan High Court’s stirring comments on live-in relationship

Jaipur: The Rajasthan High Court has made a shocking remark on live-in relationship. The court has held that two people of legal age can live together. Even if the couple is not married, they can continue in a live-in relationship, the court said. The court said that constitutional rights cannot be denied on the pretext of marriageable age. Justice Anup Dhand made these remarks in his judgment. An 18-year-old woman and a 19-year-old boy have recently filed a petition in the Rajasthan High Court. The couple told the court that they were in a relationship with mutual consent. The couple also revealed that they had made a pact to live together on October 27, 2025.

However, the girl’s family is opposing the live-in relationship. The couple has stated in their petition that the girl’s family is threatening to kill them. The couple has also alleged in their petition that no one is paying attention to the complaint they gave to the police. Public Prosecutor Vivek Chaudhary argued against the petition. He told the court that the boy is not yet 21 years old and is not of marriageable age. He told the court that he should not be given permission to continue the cohabitation.

But the court rejected the public prosecutor’s argument. The court said that the marriageable age has not been reached and Article 21 of the Constitution cannot be taken away, the right to freedom. The court said that under Indian law, live-in relationship cannot be prohibited and cannot be considered a crime. Justice Dhand ordered the Bhilwara and Jodhpur police to examine the issues in the petition. The court said in its order that the young couple should be provided with protection.
