According to the information, Chhattisgarh State Industrial Court Raipur found Yogesh Gupta, the occupier of Dondekhurd-based RC Casting Industries, guilty under Section 92 and 96-A of the Factories Act 1948 and punished him with 2 years of simple imprisonment and a fine of Rs 10 lakh. Is. It may be noted that Yogesh Gupta is the owner of RC Casting Industries Dondekhurd. Their factory was inspected by the Industrial Health and Safety Officer on 20.11.2014.
Then he had found that the occupier of the factory, Yogesh Gupta, had not kept the paid leave related to the contract workers. Health check-up of workers employed in dangerous process was not done. The workers were made to work without safety equipment, safety shoes, helmet, nose mask and hand gloves. Factory occupier Yogesh Gupta said that a commercial health center was not built in the factory. The pressure vessels and EOT installed in the factory were not inspected by a competent person appointed by the Chief Factory Inspector. Fire extinguishers were not arranged. The accused factory is of dangerous category. A safety committee was not formed by the accused to ensure the participation of workers. For this reason, the complainant had filed a penal complaint in the Labor Court, Raipur to punish the occupier of the factory. On 23.01.2020, Labor Court Raipur passed its decision and acquitted the factory occupier Yogesh Gupta.
An appeal was submitted in the State Industrial Court Raipur against the decision of Labor Court Raipur on 23.01.2020. While disposing of the appeal on January 24, 2024, the State Industrial Court Raipur punished Yogesh Gupta, occupier of RC Casting Industries Dondekala, with two years of imprisonment and a fine of Rs 10 lakh. In case of non-payment of fine, he has been punished with additional jail term of one month for all the charges. It should be noted that State Industrial Court Raipur was established after the formation of Chhattisgarh state. State Industrial Court is equivalent to Raipur High Court. This is the first time after the formation of Chhattisgarh that the State Industrial Court has sentenced two years of imprisonment and a fine of Rs 10 lakh in a criminal case.
