Bilaspur. Chhattisgarh High Court has upheld the order of the Family Court in which the husband’s divorce petition was rejected. The wife had alleged that she was harassed at her in-laws house because of the dark color of her skin.
The petitioner, a resident of Kasdol in Balodabazar district, got married on 20 April 2005. After a few months, he went to Hyderabad with his wife in connection with his job. Later both of them returned. According to the husband, after this the wife went to her maternal home and did not return even after several attempts. The husband filed a petition in the family court demanding divorce.
It was told from his side that his wife did not want to live with him citing his weak financial condition as the reason. A reply was filed on behalf of the wife that there was no truth in this. Her husband used to torture her physically and mentally because she was of dark complexion. Due to this, she even tried to commit suicide once. The husband wants to marry someone else, so he wants a divorce.
The High Court upheld the decision of the Family Court and rejected the divorce petition. The bench of Chief Justice Ramesh Sinha and Justice Deepak Kumar Tiwari said that we should not encourage the color of human skin. We should create such an environment at home and in society that people realize that it is not necessary to have skin color for success.
