High court stayed the transfer order of teacher Saroj Singh

Bilaspur. Bilaspur. A single bench of Justice Ravindra Agarwal of the Chhattisgarh High Court has granted interim relief in favor of teacher Saroj Singh and has stayed her transfer order for the time being. The court has directed that the petitioner will submit a fresh representation to the concerned department within the next two days, and till then the stay on her transfer order will remain in effect. Advocate Anadi Sharma, while pleading on behalf of the petitioner, argued before the court that his client has been working in the current school since the year 2018 and has taught Geography along with English, because no other teacher of Geography subject was available in the school. Despite this, she was unilaterally transferred to a school located 45 kilometers away, while another lecturer Anupama Saravgi, who was recently reinstated by the order of the High Court, has been posted to teach English in the same school. Advocate Sharma also pointed out that the petitioner has more seniority, and her transfer will affect the quality of education as well as her family obligations. The single bench of Justice Ravindra Agarwal, considering the arguments of the petitioner prima facie, has kept the transfer order in abeyance and directed that the petitioner should submit a fresh representation within two days, on which the department will consider and take a decision as per rules. This order is being considered an important step towards curbing arbitrary transfers of teachers within the state, especially in cases where years of service, subject expertise and judicial balance are ignored.
