False promise of marriage, allegation of HIV infection

Dhenkanal. A woman in Odisha’s Dhenkanal district has lodged a serious complaint with the district administration, seeking justice. She alleges that a man won her trust by promising marriage and engaged in intimate relations with her. The woman states that she later discovered the man was HIV-positive and found herself to be HIV-positive as well after coming into contact with him. She has submitted a written complaint to the District Collector, demanding an impartial investigation and strict action in the matter.

According to the complaint, the accused had assured the woman of marriage, and it was based on this trust that they entered into an intimate relationship. The woman alleges that the accused concealed his health status and HIV infection from her at the time. Later, upon undergoing a medical examination, she tested positive for HIV. She subsequently asked the accused to honor his promise of marriage, but he allegedly refused to marry her.

The woman states that the accused’s conduct has caused her deep mental, social, and emotional trauma. She alleges that she was not only deceived but that her health was also put at grave risk. In her complaint, she noted that had she been aware of the accused’s health status beforehand, she would never have made such a decision.

The woman has leveled another serious allegation in her complaint, claiming that the man has engaged in unprotected sexual relations with several other women. She fears that if these allegations are not investigated in time, other women could also contract the infection. Consequently, she has urged the district administration to conduct an immediate inquiry and take necessary steps to prevent potential transmission.

In the complaint, she has requested the administration to conduct a thorough investigation into the accused’s activities and, should the allegations prove true, to take strict legal action against him. She has also demanded that women who may have come into contact with the accused be identified and provided with necessary medical testing and counseling to curb the spread of the infection. The woman has requested the District Collector not to view the matter merely as a personal dispute but to treat it as a serious issue concerning public health and women’s safety. She maintains that a failure to take timely action could impact many others.

The matter has sparked local discussion since coming to light. However, the administration has not yet issued a detailed official statement regarding the complaint. It remains unclear which agency will handle the investigation or whether a preliminary inquiry has even commenced.

Legal experts state that if an individual is proven to have knowingly concealed their health status—thereby deceiving another person while engaging in a relationship—various legal provisions could apply, depending on the circumstances and available evidence. However, an impartial investigation and the completion of the judicial process are essential before any conclusions can be drawn.

Health experts emphasize the importance of societal awareness, timely testing, and safe practices regarding HIV infection. While an individual’s HIV status is confidential medical information, serious allegations involving the risk of transmission prompt investigations by relevant authorities in accordance with legal and medical guidelines. At the same time, it is equally crucial to avoid discrimination against HIV-positive individuals and to respect their privacy.

Currently, the matter remains at the complaint stage, and the allegations have not been independently verified. All eyes are on the action the district administration takes regarding the complaint and the facts that emerge during the investigation. If the investigation substantiates the woman’s allegations, further legal action may be taken against the individual concerned; conversely, if sufficient evidence to support the allegations is not found, a decision will be made accordingly.

This entire episode underscores, once again, the importance of transparency in personal relationships, health-related responsibility, and adherence to the law. Furthermore, ensuring an impartial investigation, providing necessary support to the aggrieved party, and safeguarding public health are considered the administration’s primary responsibilities in such cases.
