High court declared employee’s dismissal illegal, got justice after 25 years

After a long wait of 25 years, Rajnandgaon resident Abdul Rehman Ahmed has got justice. He was appointed on 31 August 1989 to the post of Tracer in the Chief Engineer Office, Mahanadi Basin, Water Resources Department. After some time, on 16 October 1989, his services were transferred to the Superintending Engineer Office. But in 1991, he was dismissed on charges of association with Anand Marg Sanstha. chhattisgarh news

chhattisgarh The Madhya Pradesh State Administrative Tribunal had declared this dismissal illegal and ordered reinstatement, but the Water Resources Department refused to pay salary and other benefits from 1991 to 1999. Abdul Rehman again resorted to the tribunal, but after the division of the state, the case went to the Chhattisgarh High Court. In the High Court, this case was registered as a contempt petition. Sacked

During the hearing, the court unilaterally dismissed the case due to non-submission of timely reply by the state government. Despite this, when the petitioner did not get the back wages, he filed a petition again in 2006. Now, after 25 years, the High Court has given its verdict. High Court Justice Gautam Bhaduri has said in his decision that when the High Court declares the dismissal of a government employee illegal, he should be reinstated without any additional investigation and should get full salary, allowances and other benefits for the period of out of service. The court has directed the state government to pay the pending salary and allowances.
