Violence case: Big setback to MP, High Court rejects this demand
Prayagraj: Samajwadi Party MP Ziaur Rahman Barq from Sambhal Lok Sabha seat of Uttar Pradesh has suffered a major setback. Allahabad High Court has refused to cancel the FIR registered against MP Burq. The court said that the FIR will not be canceled and the police investigation will continue. However, the High Court has directed the police not to arrest MP Burq. In this case, an old order of the Supreme Court has been asked to be implemented. The High Court has said that the sections under which FIR has been registered against MP Burq have a punishment of less than 7 years.
In this case, the police will issue a notice to MP Burq. Police can call Ziaur Rahman Barq for questioning by issuing a notice. MP Ziaur Rahman Barq will have to cooperate in the police investigation. SP MP Burq had challenged the FIR in Allahabad High Court and pleaded to cancel it. A division bench of Justice Rajiv Gupta and Justice Azhar Hussain Idrisi heard the case.
The police had registered a case against Samajwadi Party MP Ziaur Rahman Barq and local MLA’s son Sohail Iqbal on charges of inciting violence during the survey of Jama Masjid in Sambhal, Uttar Pradesh. After the FIR was registered against MP Barq, Akhilesh Yadav had said, “This incident is sad. Our MP was not present in Sambhal yet an FIR has been registered against him. He was in Bengaluru at that time. This entire riot has been organised and the government has done it.”
