Son who approached High Court against biological father gets justice

Bilaspur: High Court has given rights to a child born to an unmarried mother 29 years after his birth. The court has considered him a legitimate son and said that he is entitled to get all the benefits from the biological father. High Court has rejected the decision of the family court as it is not in accordance with the law.

In fact, a youth living in Surajpur district had filed a complaint in the family court for maintenance and rights in the property of his biological father. Where after hearing, when the case was rejected, the youth appealed in the High Court. In which it was said that his biological father and mother lived in the neighborhood, his mother became pregnant due to their love affair. The father asked for abortion, but the mother refused and filed a report of the case. After which a boy was born in November 1995. He stayed with his mother. The mother filed a case in the family court for maintenance of herself and the child. The family court did not consider it maintainable as the declaration of property rights was not within the scope of the marital side. He appealed in the High Court against this decision.

Here in April 2017, when the young man fell ill, due to financial crisis, he went to his biological father’s house and asked for financial help for treatment, but he refused. Angered by this, the young man first presented his property claim in the family court, which was rejected by the family court, then an appeal was made in the High Court. Where the hearing was held in the division bench of Justice Gautam Bhaduri and Justice Rajni Dubey. After hearing the case, the court rejected the conclusion recorded by the family court. The High Court declared the young man as the legitimate son of both. Also, he has been declared entitled to all the benefits received from the father. The appellant young man was born in 1995, he is about 29 years old. The young man got his rights from the High Court after a long fight.
