Raped a women After kidnapping, the accused got 20 years in jail

Ambikapur. The court of Additional Sessions Judge Fast Track Court (POCSO Act) Pooja Jaiswal has sentenced the accused Sunil Toppo (24) to 20 years imprisonment and fine on the charge of abducting a minor from Ambikapur city about four years ago and raping him. If the fine amount is not paid, the accused will have to face additional imprisonment. The accused is a resident of village Binjpur under Bhandaria police station of Garhwa district of Jharkhand. He took the victim from Ambikapur and kept her with him for 10 days. During this time, she threatened to kill and rape her for the sake of marriage.

Additional Public Prosecutor Rakesh Sinha said that the incident took place on 29 October 2019. The victim had got down from the bus at an intersection to come to her home in Ambikapur. During this time the accused had taken her along with him by luring her. A complaint about this incident was lodged in the police station on November 3, 2019. After investigation, the police recovered the victim and also arrested the accused. An FIR was lodged against the accused under sections of the Protection of Children from Kidnapping, Rape and Sexual Offenses Act. After sending the accused to jail on the orders of the court, the police presented the case in the court. The court of Additional Sessions Judge Pooja Jaiswal, after hearing all the facts of the case and on the basis of sufficient evidence, convicted the accused of kidnapping, rape and sexual crimes against children. He has been sentenced to imprisonment and fine under sections of the Protection of Children from Sexual Offenses Act. The maximum punishment given is 20 years. In this case, the court has also ordered to provide compensation of Rs 4 lakh to the victim as per the plan of the state government.

Generally, it is being seen that nowadays the incidents of kidnapping and rape of minor girls are increasing. Such a crime is against the entire society. The crime of rape is the most morally and physically condemnable crime in the society because it is an attack on the body, mind and privacy of the victim. Just as a murderer destroys the physical structure of the deceased, similarly a rapist shatters the soul and essence of life of a helpless woman and leaves a permanent mark on the life of the victim. This is a violation of the human rights of the victim. Rape, being the most heinous of crimes, is a serious blow to the supreme dignity of a woman and seriously injures both her honor and reputation. Therefore, the accused will have to face the consequences of the crime committed by him.
