Police officers in Bihar have magisterial powers
Patna. The Bihar government has granted additional powers to police officers to maintain law and order during processions, fairs, and other religious and public events held during festivals. The government has conferred the powers of ‘Special Executive Magistrate’ upon Range and Zonal IGs and DIGs, as well as district-level SSPs, SPs, City SPs, and Rural SPs. A notification to this effect has been issued by the Police Wing of the Home Department.
The objective of this government decision is to effectively manage the law and order situation during major events held during festivals. Large gatherings at fairs and processions present the administration with numerous challenges, such as traffic control, crowd management, security, and the prevention of potential disputes. Granting Special Executive Magistrate powers to senior police officers will facilitate quick decision-making and the execution of necessary administrative actions on the spot.
Powers Granted to Senior Police Officers Including IGs and DIGs
According to the notification issued by the Home Department, these powers have been conferred upon IGs and DIGs posted in Ranges and Zones. Additionally, SSPs, SPs, City SPs, and Rural SPs posted in the districts have also been granted the powers of Special Executive Magistrate. However, in the case of Rural SPs, railway-related posts have been excluded from this arrangement.
Under this system, the concerned police officers will be able to take necessary measures based on the law and order situation in their respective areas during festivals. Possessing the powers of a Special Executive Magistrate will allow police officers to exercise certain administrative rights related to law and order, rather than being restricted solely to policing duties.
Challenges Increase During Festivals
Fairs, religious events, and processions are organized across Bihar throughout the year on the occasion of various festivals. Large numbers of devotees and members of the general public participate in these events. In many places, crowd and traffic pressure increases along procession routes. Furthermore, the administration must exercise extra vigilance regarding security arrangements in sensitive areas. Even a minor incident during any event can escalate into a major controversy. Railway Sector Excluded
The notification includes a specific provision regarding the Rural SP. The powers granted to the Rural SP do not extend to railway-related functions. In other words, while this system applies to the relevant police officers posted in rural areas, the Rural SP’s role concerning railway matters remains outside its scope.
The government has taken this step at a time when the administration needs to exercise heightened vigilance regarding security arrangements during the festive season. The number of processions and fairs increases alongside the surge in crowds during festive seasons. Granting additional powers to police officers in this context is expected to aid in maintaining law and order.
