Major order by Mandi Court: Instructions issued to take possession of defaulter’s property.

Market: A court in Mandi, Himachal Pradesh, has issued a significant order regarding a case of loan default. The Mandi court has directed the concerned authority to complete the process of taking possession of the mortgaged property—intended for the recovery of the bank’s outstanding loan—within one month. Legal proceedings in the matter are expected to accelerate following this court order.

According to the details of the case, the bank initiated recovery proceedings under the law after the borrower failed to repay the loan for an extended period. After completing the necessary legal formalities, the matter reached the court, where the bank sought possession of the mortgaged property.

During the hearing, after reviewing the available documents and records, the court directed the concerned officials to complete the process of handing over possession of the property to the bank within one month, in accordance with the rules. The court also clarified that the action must strictly adhere to applicable laws and prescribed procedures.

According to banking experts, when a borrower fails to repay a loan for a prolonged period and the account is declared a Non-Performing Asset (NPA), the bank has the right to recover the outstanding amount from the mortgaged property under relevant laws. However, such action is taken only after adhering to judicial and statutory processes.

Following the court’s directive, the concerned administrative officials will now undertake the necessary action within the stipulated timeframe. Unless the borrower obtains statutory relief or a contrary order from a higher court, the process of handing over possession of the property to the bank will proceed.

This order is considered significant for cases where banks have been pursuing legal avenues to recover long-standing outstanding loans. Experts state that timely action helps maintain discipline within the banking system and safeguards the interests of financial institutions.
