High Court’s decision reserved in DGP-SP case

Shimla. The State High Court reserved its decision on the applications related to withdrawal of orders related to transfer of DGP Sanjay Kundu and SP Kangra Shalini Agnihotri.

After a day-long hearing, the division bench of Chief Justice MS Ramachandra Rao and Justice Jyotsna Rewal Dua reserved its decision after hearing the arguments given by all the parties. This matter is being heard in the High Court regarding the security of Palampur businessman Nishant Kumar Sharma and independent investigation of the case.

The court has already issued interim orders to provide proper security to the businessman. In this case, Nishant Sharma demanded from the court to suspend SP Kangra Shalini Agnihotri. Applicant Nishant Sharma accused SP Kangra of negligence in discharging his duties.

On behalf of the DGP, the court was told that his intention in contacting Nishant was only that he wanted to resolve the matter by mediating between the two parties. On his behalf, the court was told that he is going to retire within three months, hence being innocent, they want him to take honorable retirement from the police department.

It is noteworthy that after getting interim relief from the Supreme Court, Kundu has filed an application requesting to withdraw the decision of the High Court to transfer him to some other post. SP Kangra Shalini Agnihotri has also filed an application demanding withdrawal of the orders given against her.

On December 26, the High Court had ordered the removal of DGP Sanjay Kundu and SP Kangra Shalini Agnihotri from their current posts. The court ordered the Home Secretary to take necessary steps in this regard soon. After this, Kundu got interim relief from the Supreme Court and obtained a stay order on his transfer.
