High Court gave instructions to give promotion to the employee, the case continued for 10 years
Bilaspur. After a ten-year legal battle, a Class III employee of the Municipal Corporation in Bilaspur has now got justice on the orders of the High Court. The Urban Administration Department has ordered to give the benefit of seniority along with promotion to the employee. Earlier the officers of the department were not following the orders of the High Court. On which the employee had to file a contempt petition.
Sarvesh Tiwari has been working as Assistant Grade-3 in Municipal Corporation since 1983. In 2008, the Municipal Corporation changed the post on administrative grounds and merged it, giving it the benefit of seniority since 1983. But, instead of accepting this order of the Municipal Corporation, the Urban Administration Department issued a separate order in 2015 and reduced the name in the seniority list.
Challenging this order of the Urban Administration Department, Sarvesh Tiwari filed a petition in the High Court. On a petition filed in 2015, the High Court ruled in favor of the petitioner in 2023 and ordered him to be senior in Assistant Grade 3 since 1983. But, the Municipal Corporation and Urban Administration Department appealed against the decision of the Single Bench in the Division Bench. During the hearing of the case, the Division Bench also ruled in favor of the petitioner and upheld the order of the Single Bench.
Due to a prolonged court case, petitioner Tiwari, a junior employee, got promotion and became Assistant Superintendent. But, the officers of Municipal Corporation and Urban Administration Department did not follow the order of the High Court. On which he filed a contempt petition in the High Court through his advocate Vikas Dubey. On this, the single bench of Justice Partha Pratim Sahu issued contempt notice to the officers of the corporation. Then the Municipal Corporation Administration issued an order to give the benefit of promotion and seniority to the petitioner to avoid contempt.
