CG: Notice to education department, court’s strictness in transfer policy

Bilaspur. Bilaspur. A single bench of Justice Ravindra Agarwal of the Chhattisgarh High Court has granted interim relief in favor of the teacher and has suspended her transfer order for the time being. This order is important in view of the transfer of teachers being done in schools under rationalization. Advocate Anadi Sharma, while pleading on behalf of the petitioner, argued before the court that his client Saroj Singh has been working in the current school since the year 2018, and has taught Geography along with English, because no other teacher of Geography subject was available in the school. Despite this, she was unilaterally transferred to a school located 45 kilometers away, while another lecturer, who was recently reinstated by the order of the High Court, has been posted to teach English in the same school. Advocate Sharma also pointed out that the petitioner has more seniority, and her transfer will affect the quality of education as well as her family obligations. The single bench of Justice Ravindra Agarwal, considering the arguments of the petitioner prima facie as worth consideration, has kept the transfer order in abeyance and has directed that the petitioner should submit a fresh representation within two days, on which the department will consider and take a decision as per rules.
