Asking for a girl’s mobile number proved costly, the High Court said a big thing

Ahmedabad: Gujarat High Court said that asking a girl’s name and number is wrong but it cannot be considered sexual harassment. In fact, the police have registered a case against Samir Roy of Gandhinagar. A case of sexual harassment has been registered against Samir for asking a woman’s name, number and address. According to a TOI report, a case was registered against Samir on April 26. Samir told the High Court that when he accused the police of atrocities, a case of sexual harassment was filed against him.

Sameer says that the police tortured him on April 25. He also complained against the police regarding this. He has also accused the police of snatching his phone and deleting his data. In his petition, Samir said that he came to know about this case (sexual harassment) on May 9. Gujarat High Court has questioned this action of the police. Justice Nirjar Desai said, ‘If someone asks what is your number, then it is wrong, but this is not a case to register an FIR. Is there any wrong intention in this?’

Justice Nirjar Desai said, ‘Yes, this (asking for number) can be inappropriate, but the court believes that if section 354 of IPC is seen, then it is about sexual harassment and its punishment.’ In fact, the woman had lodged a complaint of sexual harassment against the youth under section 354A of IPC. The court further said, ‘Even if the things written in the FIR are true, then also asking for the number from the woman by the youth cannot be sexual harassment. This is inappropriate but not sexual harassment.’
