Accused sentenced to 4 months in jail for cheque bouncing, directed to pay Rs 6 lakh to victim

Durg. After receiving the money on loan, the accused’s check was dishonored. The court of Deepak Kumar Koshle, Fifth Additional Sessions Judge, Durg, has ruled against the accused. The court sentenced Suresh Kumar Pillai to four months’ rigorous imprisonment and ordered him to pay a compensation of ₹6 lakh under Section 138 of the Negotiable Instruments Act. Advocate Awadhesh Rai represented the complainant.

Accused Suresh Kumar Pillai, a resident of International Talpuri Colony, Bhilai, was acquainted with the complainant, Mrs. Ittu Rani Dutta, wife of the late Nirupam Dutta, of Road No. 21, Sector 8, Bhilai. In need of money, accused Suresh Kumar Pillai borrowed a check for ₹4 lakh and ₹1 lakh in cash from the complainant’s husband, Nirupam Dutta, on January 24, 2015.

When the complainant’s husband demanded the money, the accused provided a check for ₹5 lakh on October 26, 2021. When the complainant deposited the check with the State Bank of India branch in Sector 10, Bhilai, to withdraw the amount, the accused placed a stop on the check, resulting in the check being dishonored. Complainant Ittu Rani Dutta sent a notice to the accused through her lawyer, but the accused made no effort to pay the amount. Frustrated, the complainant filed a complaint in court through her lawyer.
