The Central Government is preparing to further tighten the law to curb the recurring incidents of exam paper leaks across the country. The proposed amendments include provisions for severe penalties against paper leaks, theft of question papers, sale of answer keys, technical tampering, and organized exam mafias involved in public examinations. The new proposal entails a maximum imprisonment of 10 years and a fine of up to ₹50 lakh for the guilty.
The government believes that despite existing laws, exam mafias are jeopardizing the future of the youth through new technologies and organized networks. Therefore, there is a need to make the law more effective to ensure swift and stringent action against the perpetrators.
Why were changes necessary?
In recent years, incidents of paper leaks in various recruitment and entrance examinations have affected lakhs of candidates. Several exams had to be cancelled, resulting in a waste of students’ time and effort, as well as a loss of financial resources. In light of these events, the government has drafted a proposal for comprehensive amendments to the law.
7 Major Proposed Changes
- Increased prison term
A provision has been made for a maximum imprisonment of 10 years for those involved in paper leaks or organized crimes related to examinations. In serious cases, the minimum sentence may also be made stricter than before. - Fine of up to ₹50 lakh
Individuals, agencies, or organizations found guilty could face a financial penalty of up to ₹50 lakh. Even harsher financial action could be taken against large organized gangs. - Special action against exam mafias
There is a proposal to take strict action by classifying gangs responsible for paper leaks, middlemen, ‘solver gangs’ (hired test-takers), and networks providing technical assistance under the category of organized crime. - Digital crimes included
If a question paper is leaked via mobile phones, social media, messaging apps, email, or other digital mediums, it will be treated as an equally serious offense. - Provision for asset confiscation
There is a proposal to empower investigative agencies to confiscate illegal assets and financial gains acquired through paper leaks. 6. Accountability of institutions to be fixed
If negligence or collusion on the part of an examination-conducting body, agency, or its employees comes to light, legal action can be taken against them as well. - Speedy investigation and expedited hearings
A proposal has also been made to strengthen the legal framework to ensure time-bound investigations into cases like paper leaks and expedited hearings in special courts.
An effort to restore students’ trust
The government states that the objective of these changes is not merely to punish the guilty but also to enhance transparency and credibility within the examination system. Strict laws will help curb the ‘exam mafia’ and bolster the confidence of hardworking students.
Experts believe that stringent laws alone will not suffice. Measures such as a secure digital examination system, monitoring of question papers, encrypted transmission, robust cybersecurity, and enhanced oversight of examination centers are equally essential.
