Biga Cheese gets relief from SC against Fonterra

World World: Bega Cheese said on Monday that the Supreme Court of New South Wales has dismissed a case filed by Fonterra. The case related to trademark licensing agreements and the New Zealand dairy company’s divestment plan. Last November, Fonterra’s Australian units took action against Bega Cheese, requesting that Fonterra’s divestment proposal does not affect existing trademark licensing agreements, and that there be scope for changing certain control clauses in these agreements.

Bega Cheese and Fonterra have trademark licensing agreements under which Fonterra is allowed to use Bega’s trademarks, particularly on dairy products such as cheese and butter. In February, Fonterra planned to talk to potential buyers for its global consumer business and integrated business, which could include a sale and an initial public offering (IPO).
